These sections of South Carolina's Hazardous Waste Management Act outline what nonresponsible parties are required to include in their voluntary cleanup contract, which addresses proposed future land uses and a copy of any restrictive covenants. Once the South Carolina Department of Health and Environmental Control (SCDHEC) determines the nonresponsible party has successfully and completely complied with the contract and has completed the voluntary cleanup, SCDHEC will issue a covenant not to sue. The covenant not to sue will be revoked by SCDHEC for conducting activities at the site that are inconsistent with the terms and conditions of the voluntary cleanup contract.
