This article examines the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and its effect on federal and state brownfields redevelopment programs. The article provides basic background information on the approach taken towards brownfields cleanup under CERLCA and argues that this approach created a range of environmental, economic, and environmental justice concerns. The article also discusses how the Small Business Liability Relief and Brownfields Revitalization Act (Brownfields Law) changed CERLCA and the intended effect of these changes on brownfields cleanup. Finally, the article discusses whether the reforms brought by the Brownfields Law will have the desired effect on brownfields redevelopment. (Date Approximate)
