Appendix G, Environmental Land Usage Restriction (ELUR), provides the boilerplate format for establishing land use restrictions pursuant to section 8.09 of the State of Rhode Island’s Remediation Regulations. The model ELUR outlines acceptable and prohibited activities according to the restriction and any on site engineering controls. The model ELUR provides a procedure for the suspension of certain prohibitions in the event of an emergency. Property owners must obtain approval from Rhode Island Department of Environmental Management prior to making any changes to the site that are inconsistent with the ELUR. Parties holding a lease or any other interest in the restricted site must be required by the ELUR holder to comply with all terms of the ELUR. The ELUR runs with the land and binds all successors and assignees. The property owner must submit annually a report evaluating compliance. (updated February 2004)
