This Connecticut Law Review article, authored by Amy L. Edwards, evaluates the current and potential application of institutional controls through the Brownfields Revitalization Act, other federal and state laws, and the Uniform Environmental Covenants Act. The article provides background information on institutional control types, guidance and relevant law as well as an outline of the Uniform Environmental Covenants Act (adopted on August 6, 2003 by the National Conference of Commissioners on Uniform State Laws (NCCUSL)). The article conveys the key role that stakeholder confidence plays in the success of Brownfields revitalization efforts. Implementation and enforcement mechanisms for institutional controls must withstand limitations or “transactional and enforcement issues” and clearly define stakeholder responsibilities, rights, liability and what entities retain an interest in land.
