This fact sheet summarizes California Assembly Bill 2436 (Chapter 592, Stats. 2002, effective Jan. 1, 2003) which requires the California Department of Substances Control to include within its list of recorded land use covenants certain proprietary and environmental information about use restricted properties. The fact sheet provides background information on what land use covenants are and why they are used. The fact sheet also summarizes section 67391.1 of title 22, division 4.5, chapter 39 of the California Code of Regulations, which specifies that a land use covenant imposing land use restrictions must be executed and recorded when residual contamination will remain on the property at levels unsuitable for unrestricted use of the land.
