This statute, 25398.6, describes the qualifications for site remediation actions. The statute lists qualifying factors for remedial actions, including land use controls. Qualified remedial actions should be submitted in a remedial action plan including analyses of cost-effectiveness, ability to implement, long and short-term site uses and protection, and will be subject to public comment. Approved land use controls must be recorded in the county where the site is located. The California Department of Toxic Substances Control must approve any modifications.
