This model restrictive covenant, or Declaration of Environmental Use Restriction, is used to implement land use controls at properties remediated under the Arizona Department of Environmental Quality (ADEQ) regulatory program. This model is appropriate when an institutional control is incorporated in a remedial action plan or when a property is remediated to non-residential use. The model restrictive covenant sets forth limits on the use of the property, establishes requirements to maintain the integrity of the remedial action, and identifies why the property is restricted (e.g., because contamination remains above residential standards).
