Title 7, Chapter 26E, Subchapter 8 of the New Jersey Administrative Code establishes the requirements for the use of institutional controls (ICs) and engineering controls (ECs) in remedial actions for contaminated properties. Subchapter 8 includes the following sections: section 8.1 addresses the general requirements for the use of ECs and ICs in remedial actions; section 8.2 details what information must be in a deed notice that is used as part of a soil remedial action; section 8.3 deals with the process for using a groundwater classification exception area as an IC; section 8.4 establishes requirements for monitoring and maintaining remedial actions that include ICs or ECs; section 8.5 establishes procedures for monitoring and maintaining remedial actions that include deed notices or declarations of environmental restrictions; and section 8.6 sets forth the monitoring and maintenance requirements for remedial actions that include a groundwater classification exception area.
