On March 22, 2005, Nebraska enacted the Uniform Environmental Covenant Act (UECA) when Governor Dave Heineman signed LB 298 into law. UECA establishes a process for creating, modifying and enforcing environmental covenants. Environmental covenants created under UECA will not be subject to common law rules, which have prevented land use restrictions from enduring over time. UECA requires environmental covenants to be recorded in the local land records and thereby bind successive owners of the property.
