This model Brownfields Agreement is used to set forth a plan by which contaminated property will be remediated and developed pursuant to the North Carolina Brownfields Property Reuse Act. The model agreement grants liability relief for contamination at the property subject to the agreement provided that all actions set forth in the agreement are completed. The model agreement requires site specific environmental information, a description of how the redevelopment of the property will benefit the community, and a description of any remediation activities that are to be performed. The description of remedial action must identify any land use restrictions that will be used to ensure that the property is safe for the uses specified in the agreement.
