This interim rule sets forth a method for calculating the fee that must be paid to the Arizona Department of Environmental Quality (ADEQ) when a Declaration of Environmental Use Restriction (DEUR) is part of a remedial action plan for contaminated properties addressed under Arizona remediation standards. The revenues generated from this rule will serve as the principle source of funding for the state Institutional and Engineering Control Fund. Monies in the state Institutional Control and Engineering Control Fund will be used by the ADEQ for administrative oversight costs associated with the use of DEUR’s in environmental remediation and for reasonable and necessary costs of administering the fund.
