This section of the Arizona Revised Statues, at Title 49, Article 4 (49-152,158, 159) establishes procedures for imposing legally enforceable institutional controls (ICs) and land use restrictions. The section requires a property owner to record a restrictive covenant in the county where the property is located if the owner chooses to remediate a site to nonresidential use or if a corrective action includes the use of an IC. The section describes the information that must be included in the covenant and establishes that the covenant runs with the land, burdens the property owner, and inures to the benefit of the Arizona Department of Environmental Quality.
