Council-Manager Agreement Interpretation

Greetings Everyone

Would some of you lend a few keystrokes to the interpretation of this provision in the ICMA Manager Contract?

Any assistance and/or direction would be greatly appreciated...

Section 5. Hours of Work
It is recognized that Employee may devote a great deal of time outside the normal office hours to conduct business, and to that end Employee will be allowed to take compensatory time off.

This provision in no way shall limit the council from evaluating the management of compensatory time off as it relates to the overall performance evaluation of Employee.

Sorry that this is too late, but as I read it, take the time off at your own risk. The time taken off can be evaluated as a part of your over-all evaluation.

I'm responding late also, but in our City all salaried personnel (exempt from FLSA) including the Manager are expected to work the time it takes to do the job and there is no such thing as "comp time". Time can be taken to take care of personnel items, but there is no comp time as such.

It means that the manager will be evaluated based on concrete performance goals, not whether she was in her office every morning at 8 a.m. on the nose. All those night meetings add up, and Council never knows whether the manager is at a regional planning meeting, a breakfast discussion with peers, or just recovering from a tough public meeting. Further, most managers are on the job 24/7: emergencies and Council questions don't wait for Monday. Some jobs require a rigorous office presence, but others -- like ours -- are less clock bound.

You can take compensatory time off at your own risk. You may be evaluated for the time taken off as a part of your over-all evaluation. Best to hope that your organization functions well while you are away. Of course you get to hold your staff accountable upon your return. You just never know how different members of the council will interpret any "problems" that may arise.
